THE NEED TO IMPROVE VICTIM-FOCUSED POLICIES ON WORKPLACE SEXUAL HARASSMENT IN PUBLIC INSTITUTIONS
Abstract
The author critically analyzes the differentiated state policy under Law No. 27942, which undermines the protection of women victims of workplace sexual harassment in the public sector. This law offers less comprehensive protection compared to Law No. 30364, which includes risk assessment, broader evidence criteria, unrestricted labor rights, and prohibition of gender stereotypes. The author concludes that this disparity leaves public-sector victims with insufficient protection, creating discrimination that violates their dignity and fundamental rights.
