ANALYSIS OF THE QUALIFICATION OF THE VIRTUAL PROVIDER IN LIGHT OF ADMINISTRATIVE JURISPRUDENCE ON THE COMPLAINTS BOOK
Abstract
In this paper, the author analyzes the interpretation adopted by the Specialized Chamber for Consumer Protection of INDECOPI regarding the obligation of a supplier to implement a virtual Complaints Book on its web portal, even when it does not allow economic transactions. Through critical analysis, the pertinence of invoking the principle of in dubio pro consumidor as a basis for this position is evaluated, concluding that its application is unnecessary and that, in addition, it violates the principle of typicality.
