THE PROPERTY RELATIONS OF FAMILIES IN COHABITING UNIONS IN PERU
Abstract
The present investigation aimed to analyze the implications that a legislative change in the property regime of separation of assets directed towards common-law couples in Peru would bring, for this purpose, a qualitative methodology of a systematic and documentary type was used, which synthesized the collection of information from multiple university theses from both national and foreign scope that address the analyzed problem, as well as four sentences of the Peruvian registry court, from 2019 to 2022 that regulated for the first time in Peru this possibility of change of property regime in common-law marriage, in that sense it was concluded that the possibility of change of regime is present in the legislation even if it is not regulated, however its prescription is important in order to avoid these processes and /or sentences that may restrict the rights of autonomy and family protection.
