SECURITY MEASURES IN PERÚ. MEETINGS AND DISAGREEMENTS
Abstract
The research addresses the importance of mental health in Peru, in addition to security measures in people declared unresponsive in the face of psychological affectation. To do this, we will review the international legal framework and national legislation on this problem where there is mental impairment of people that often leads them to carry out harmful acts towards other people and can also endanger their own lives. Then we will review the statistics of cases of non- imputability, then the criteria for determining the security measure and when cases may vary. This mental health problem is exacerbated by the lack of coordination of the different sectors such as: the Judiciary, the National Penitentiary Institute (INPE), the Ministries of Justice and Human Rights (MINJUSDH) and the Ministry of Health itself (MINSA). Therefore, timely and rapid intervention is required in the face of the vulnerable condition of these people and the application of immediate strategies.
