Abstract

This article addresses the relationship between the right to identity and the right to family in the context of the constitutional state of law. It highlights the importance of these fundamental rights, especially regarding the acquisition of names and surnames that shape an individual's identity. It argues that identity is constructed through the family, and vice versa, emphasizing the interconnectedness between both concepts. Additionally, it questions whether a Peruvian citizen should have the possibility to choose to bear the surname of one of their ancestors, instead of the paternal and maternal surnames, as part of their constitutional right to identity.
