SOME SOCIO-HISTORICAL NOTES ON THE ORIGIN OF THE AMERICAN CONVENTION ON HUMAN RIGHTS AND THE DEVELOPMENT OF CONVENTIONALISM

Abstract

This review historically analyzes two central elements of Inter-American Human Rights Law: the conflictive geopolitical setting of the Fifth Meeting of Consultation of Ministers of Foreign Affairs of the Organization of American States (OAS, 1959), which gave rise to the Inter-American Specialized Conference on Human Rights (OAS, 1969), and the evolution of conventionalism derived from the doctrine of Mr. Sergio García Ramírez, former president of the Inter-American Court of Human Rights, known as conventionality control.

The research warns that this doctrine has been undermining the protection of women’s rights and affects the original meaning of the human rights treaties signed by the American countries.
