WHY IT’S IMPORTANT FOR ONLINE GAMBLING TO HAVE A REGULATORY FRAMEWORK?
Abstract
Games and betting have evolved over time, from social activities to ones with a strong economic component. The definition of games and betting according to Carlos Fonseca focuses on regulated activities for entertainment, albeit with the obligation to risk economic assets. There are different categories of games, some depending on luck and others on the player's skill. In the legal sphere, the Civil Code establishes the basis for gaming and betting contracts, and Peruvian legislation prohibits certain types of games and bets. However, the regulation of online gaming and betting is limited, leading to a legal vacuum that betting houses exploit to attract more players. This lack of regulation raises concerns about the protection of vulnerable groups, such as minors, and about transparency in betting outcomes. Despite this, there are legislative projects aimed at regulating online gaming and betting, with the aim of guaranteeing the integrity, transparency, and security of these activities, as well as generating tax revenue for the State.
